LandOfBytes – Terms of Service

Introduction

These Terms of Service (“Terms”) are a legal agreement between you (“you”, “User”, or “Customer”) and LandOfBytes LLC(“we”, “us”, or “Company”), a company registered in Vancouver, British Columbia, Canada. By accessing or using the Service, you accept and agree to be bound by these Terms. If you do not agree with any part of these Terms, do not use the Service.

A. Definitions

Service: The collection of applications, software, APIs, dashboards, CLIs, and infrastructure provided by LandOfBytes LLC under the brand “LandOfBytes for Redis.”

User or You: The individual or entity using or accessing the Service.

Customer Data (or Your Data): Data, content, or information that you upload, store, or transmit using the Service.

Console / Dashboard: The web interface or tools through which you manage your Redis pods, view metrics, perform backups, etc.

Provisioning: The process by which new Redis pods (instances) are created and delivered to Users.

Kubernetes Cluster Infrastructure: The container orchestration layer on which Redis pods are hosted (on top of Heroku infrastructure).

B. Account Registration & Security

• You must provide accurate, current, and complete information when creating your account.
• You must be at least 18 years old, or of legal age in your jurisdiction, to use the Service.
• You are responsible for all activity under your account. You may not share credentials between multiple users.
• You must keep your credentials (passwords, API tokens) secret and notify us promptly if you suspect unauthorized access.
• We reserve the right to suspend or terminate your account if we believe it violates these Terms or poses security or operational risks.

C. Acceptable Use & Conduct Restrictions

• Comply with all applicable laws, regulations, export controls, and data protection laws.
• Do not host, transmit, or distribute content that is unlawful, infringing, fraudulent, obscene, or malicious.
• Do not use the Service to perform denial-of-service attacks, spam, crypto mining, or abusive automated activity.
• Do not reverse-engineer, reconstruct, or attempt to discover source code or architecture of the Service.
• Do not use the Service to provide a competing service or resell it without explicit permission.
• Do not impersonate others or misrepresent associations with third parties.
• Do not benchmark, stress-test, or analyze the Service in a way that degrades performance without consent.

D. Provisioning, Infrastructure & Service Description

Kubernetes-based Deployment: We host the Service on Kubernetes clusters layered over Heroku infrastructure. Each user is provisioned an isolated Redis pod to serve your data and connections.

Real-time / Instant Provisioning (not guaranteed): We aim to deliver Redis pods instantly in most cases, but this depends on cluster capacity, resource availability, and Heroku uptime. Any provisioning delay shall not constitute a breach.

Service Features: Connection code samples, web-based CLI, real-time monitoring dashboard, and manual backup functionality.

Free Plan & Future Paid Plans: Currently free of charge. We may introduce paid tiers with quotas, support levels, and SLAs.

E. Customer Data, Rights & License

• Ownership: You retain all rights, title, and interest in your Customer Data.
• License to Operate: You grant us a limited, non-exclusive, royalty-free license to process and transmit your data as necessary to provide the Service.
• Usage Limitations: We will not sell your data or use it for unrelated commercial purposes.
• Removal / Deletion: Upon request or account termination, we may delete your data, though some backups may persist for a retention period.

F. Fees & Billing (Future Paid Plans)

• We will publish pricing plans in advance. Charges may be usage-based or tiered.
• Payments may be billed monthly or annually. Partial refunds will generally not be provided.
• If payment fails, you must update your payment method; otherwise, we may suspend or terminate service.
• You are responsible for applicable taxes or duties arising from your use of the Service.

G. Cancellation, Termination & Inactivity

• You may cancel your account at any time via the console.
• After cancellation, we may retain your data for a period before permanent deletion.
• We may suspend or terminate your access for breach, non-payment, or illegal use.
• We may remove accounts that remain inactive beyond a defined threshold.
• Upon termination, your access ends immediately and we have no obligation to retain or return data.

H. Disclaimers & Limitation of Liability

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.

Third-Party Infrastructure: You acknowledge that the Service depends on providers like Heroku and Redis Ltd. We are not responsible for outages, data loss, latency, or performance degradation from such providers.

No Guarantee of Data Integrity or Availability: We do not guarantee that your data will be secure or intact. You are responsible for maintaining backup copies.

Limitation of Liability: To the maximum extent permitted by law, LandOfBytes LLC and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages including lost profits, data loss, business interruption, goodwill, or anticipated savings.

Jurisdictional Exception: Some jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, liability is limited to the minimum extent required by law.

I. Indemnification

You agree to indemnify and hold harmless LandOfBytes LLC, its officers, employees, contractors, affiliates, and agents from any claims, damages, or expenses arising out of your use of the Service, violation of these Terms, or your Customer Data.

This obligation survives termination or expiration of your account or these Terms.

J. Modifications to Terms / Service

We may modify or discontinue any part of the Service at any time without liability. Changes to these Terms take effect upon posting on our website, and continued use constitutes acceptance.

K. Governing Law & Dispute Resolution

These Terms are governed by the laws of British Columbia, Canada. You and we submit to the exclusive jurisdiction of courts located in Vancouver, BC.

M. No Professional Advice

The Service, sample code, and documentation are provided for informational and technical purposes only and do not constitute professional, financial, or legal advice.

N. Force Majeure

LandOfBytes LLC shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to natural disasters, internet outages, Heroku failures, cyberattacks, war, or government actions.
